General Terms and Conditions AutoScout24 Direct
1 General Provisions
AutoScout24 Direct is a service provided by SMG Swiss Marketplace Group AG, Thurgauerstrasse 36, 8050 Zurich (“AutoScout24” or “SMG”) for private individuals (“Private Sellers”) who wish to sell their private vehicle via an online auction (“Auction”) to a dealer active in the automobile trade (“Dealer”) (Private Sellers and Dealers are each a “User”). The Auction is conducted through the AutoScout24 Direct auction platform (“Auction Platform”).
These General Terms and Conditions AutoScout24 Direct govern the use of the Auction Platform by the Users, the Auction process, and the obligations of the Private Seller and Dealer in connection with the sale or purchase of the vehicle. They apply in addition to the General Terms and Conditions of SMG (each individually and together the “GTC”). In case of discrepancies, the General Terms and Conditions AutoScout24 Direct shall prevail. AutoScout24 reserves the right to amend the service offering of AutoScout24 Direct and the GTC at any time.
With each use of AutoScout24 Direct, the User accepts the GTC.
2 Registration and Admission as User
2.1 Private Seller
Admitted as Private Sellers are only private individuals who wish to sell their private vehicle on a non‑commercial basis, provided the vehicle is in their possession and they hold unencumbered ownership of it.
At present, a Private Seller can use the Auction Platform without a user account. Changes are subject to AutoScout24’s discretion; in such case, Section 2.2 shall apply accordingly.
2.2 Dealer
To use the Auction Platform, the Dealer must register free of charge. Participation as a Dealer is only possible after approval of the registration application and activation of the user account by AutoScout24.
Only companies primarily engaged in the automobile trade are admitted as Dealers. The Dealer must provide AutoScout24 with respective proof as part of the registration application (e.g., commercial register excerpt). In justified cases, AutoScout24 may also admit a Dealer who is not primarily engaged in the automobile trade, provided the Dealer can prove that he is commercially active in the vehicle sector (e.g., dealer license / U‑number, garage number).
The Dealer undertakes to provide AutoScout24 with correct and complete information. Changes relevant to admission as a Dealer, address changes, etc. must be reported to AutoScout24 without delay in writing.
AutoScout24 is entitled to reject a registration application or exclude a Dealer from using the Auction Platform at a later point in time, for example if the Dealer has provided false information in connection with the registration. AutoScout24 is entitled at any time to verify whether the admission requirements are still met.
The Dealer’s authorization to use the Auction Platform and the user account is personal and non‑transferable. The Dealer undertakes to treat the access data confidentially and not to disclose it to unauthorized third parties.
Deletion of the user account by the Dealer is possible, provided the Dealer has paid all outstanding invoices from AutoScout24 and is not involved in any ongoing Auction.
3 The Auction
3.1 Auction Process
Placement of the Vehicle
The Private Seller may place in an Auction only a vehicle that is in their possession and that they own free and clear of any encumbrances. The Private Seller must describe the characteristics and condition of the vehicle completely and truthfully.
AutoScout24 decides whether and when the Auction will be activated on the Auction Platform and may request clarification or completion from the Private Seller if information is missing or unclear.
Submission of Bids / Offers
The Private Seller is free to decide whether to accept a Dealer’s highest bid for their vehicle in the course of the Auction. Alternatively, the Private Seller may make a counteroffer to the Dealer based on the Dealer’s highest bid, and the Dealer may make a final counteroffer to the User based on the Private Seller’s counteroffer.
In its highest bid or final counteroffer, the Dealer must factor in the costs of collecting the vehicle from the Private Seller and all related formalities.
Bids/offers submitted or accepted by Users are binding and cannot be withdrawn. Upon successful conclusion of the Auction, a binding purchase agreement is concluded between the Private Seller and the Dealer.
In justified cases, AutoScout24 is entitled to extend the durations of bids/offers in an Auction or to delete the Auction. This is the case, for example, if AutoScout24 receives notice that the vehicle being auctioned has already been sold or is subject to a lease.
3.2 Performance of the Purchase Agreement by Private Seller and Dealer
After the successful conclusion of the Auction, the Private Seller must, against payment of the purchase price agreed in the Auction, transfer to the Dealer possession and unencumbered ownership of the vehicle as well as the associated vehicle documents.
The Dealer is responsible for collecting the vehicle from the Private Seller and for all related formalities.
It is up to the Private Seller and the Dealer to agree on the further modalities of performance of the purchase agreement (e.g., payment of the purchase price, warranties).
3.3 Breach of Obligations by Users
AutoScout24 may temporarily or permanently exclude Users from using the Auction Platform and deactivate or delete user accounts if there are indications that the use is unlawful or that the GTC are being violated.
4 Remuneration
In the event of a successful Auction, the Users owe AutoScout24 the remuneration agreed upon the Auction. Prices may be adjusted by AutoScout24 at any time.
If the remuneration has not already been paid online by the User in the course of the Auction, it becomes due for payment five days after invoicing by AutoScout24.
In the event of disputes between Users in connection with the vehicle sold in an Auction, the Users have no claim to waiver, reduction, or refund of the remuneration owed to AutoScout24. In justified cases, AutoScout24 may, at its own discretion, waive or refund the remuneration in part or in full (e.g., if the condition of the vehicle was misdescribed or the vehicle was not collected).
5 Support, Contact
AutoScout24 supports Users, at its discretion, in the use of AutoScout24 Direct. The User may contact AutoScout24 by e‑mail at direct@autoscout24.ch.
6 Data Protection
The Privacy Notice of SMG in its current version applies.
SMG may send the User information about other services and products (e.g., via newsletter or push notifications on mobile devices). If the User no longer wishes to receive such communications, they can unsubscribe at any time via the link in the footer of the newsletter or via the settings of their mobile device for push notifications.
In connection with online payments by Users via DataTrans AG, the Privacy Notice of Datatrans AG in its current version applies.
